California Privacy Notice
This California Privacy Notice (“California Notice”) supplements FBM’s Privacy Policy and applies solely to visitors, users, and others who reside in the State of California (“you”).
Under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), California residents have certain rights around the collection, use, and sharing of their personal information. These rights apply only to California residents and only to those sites or entities that meet the requirements to be covered under the CCPA/CPRA. Any terms defined in the CCPA/CPRA and not defined here have the same meaning when used in this California Notice.
A. Collection and Use of Personal Information
As set forth in our Privacy Policy, FBM collects information that “identifies, relates to, or could reasonably be linked with you or your household,” which is defined as “personal information” under CCPA/CPRA.
In addition, FBM may collect data that is not identifiable to you or otherwise associated with you, such as aggregated data. Such data is not personal information. To the extent this data is stored or associated with personal information, it will be treated as personal information; otherwise, the data is not subject to this California Notice.
B. Sources of Personal Information
FBM collects personal information from and about you from the following sources:
- From You - When you provide it to FBM directly
- Automatically - Automatically through logging and analytics tools, cookies, pixel tags, and as a result of your use of and access to the Services;
- From Service Providers – businesses that provide services for FBM or on FBM’s behalf and process personal information on FBM’s behalf, including providers of our customer support, fraud prevention, analytics services, and marketing;
- From Third Parties - From third-party sources, including our licensees, and through your interactions with us on social media.
C. Use and Sharing of Personal Information
Although FBM already describes the personal information FBM collects and processes in its Privacy Policy, the CCPA/CPRA requires that we provide disclosures using the categories of personal information used in the CCPA/CPRA.

FBM will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes other than those set forth in our Privacy Policy without providing you notice.
D. Your California Privacy Rights
As set forth above, the CCPA/CPRA provides California residents with the following rights:
1. Right to Know: You have the right to request that FBM disclose what personal information it has collected, used, shared, or sold about you, and why FBM collected, used, shared, or sold that personal information over the past 12 months. You may request that FBM disclose: the categories of personal information collected about you, the specific items of personal information that FBM has collected about you, the categories of sources from which FBM collected your personal information, FBM’s business or commercial purposes for collecting, using, selling and/or sharing your personal information, the categories of third parties FBM shares your personal information with, and the categories of information that FBM sells, shares or discloses to third parties.
2. Data Portability: You have the right to request a copy of the personal information that FBM collected and maintained about you over the past 12 months in a transmittable format.
3. Right to Correction: You have the right to request that FBM correct any inaccurate personal information that FBM has about you. However, correction requests are subject to certain limitations, and FBM may choose to delete your personal information, rather than correct it.
4. Right to Deletion: You have the to request deletion of the personal information that FBM has collected from you, and to request that FBM tell its service providers to do the same, subject to certain exceptions.
5. Right to Limit: You the right to limit FBM’s use and disclosure of your sensitive personal information for limited purposes.
6. Right to Opt-Out of Sale or Sharing: You have the right to request that FBM stop selling or sharing your personal information (an “opt-out”).
The CCPA/CPRA defines the “sale” of personal information as disclosing, sharing or making such information available to another company or third party “for monetary or other valuable consideration.” The CPRA defines the “sharing” of personal information, as disclosure of such information “for cross-context behavioral advertising, whether or not for monetary or other valuable consideration.” Under these definitions, FBM does not sell or share your personal information and further will not do so in the future without providing you with notice and an opportunity to opt-out of such sale and/or sharing.
Do Not Track. FBM does not currently have the capabilities to recognize the Do Not Track signals, settings or mechanisms, including from any Internet browsers. Therefore, any selection you make within your Internet browser will not be applied to the Services. For more information regarding Do Not Track you can visit www.allaboutdnt.org.
However, you may find information about how to opt out of and/or block or reject certain web tracking technologies in our Cookie Policy and via our Cookie Choices widget, which you can launch at any time by clicking on the heart shaped cookie icon located on the bottom right corner of our website.
7. Right to Opt-In for Minors: Minors aged 13 to 16 have the right to opt-in to the sale of their personal information. Minors aged 13 and under require parental consent before the sale of their personal information. FBM does not sell the personal information of minors aged 0 to 18.
8. Right to Non-Discrimination: FBM cannot deny goods or services, charge you a different price, or provide a different level or quality of goods or services just because you exercised any of your California privacy rights. Some of the Services, however, may require your personal information. If you choose not to provide your personal information that is necessary to provide any aspect of the Services, you may not be able to use those Services.
9. Right to Opt-In to Financial Incentives: FBM does not offer any financial incentives associated with FBM’s collection, use, or disclosure of your personal information.
E. Submitting a Verified Consumer Request
To exercise any of your California privacy rights, you can email FBM at CArequest@florencebymills.com or you can use our form, located here – https://www.florencebymills.com/pages/us-laws-compliance.
To exercise these rights, you must provide FBM with sufficient information to allow FBM to verify your identity. Your request should include your name, email address and place of residence. You must also describe your request with sufficient detail to allows FBM to properly understand, evaluate, and respond to it. Once your request is received, FBM will review it and determine if there is enough information for FBM to understand your request and if more information is necessary to verify your identity as required by law (we may request additional information from you in order to do so).
Only you, or a person authorized by you to act on your behalf, may make a verifiable consumer request related to your personal information. If you are submitting a request on behalf of a consumer, then FBM also requires that you provide verification of your authorization to request on behalf of the consumer, evidence of your identity, and evidence of the consumer’s identity.
You may only make a verifiable consumer request for your Right to Know or Data Portability rights twice within a 12-month period.
FBM will respond to a verifiable consumer request within forty-five (45) days of its receipt. FBM will let you know if we require more time to respond to your request (up to 90 days, total). FBM will deliver our written response by mail or electronically, at your option, which should be provided to us with your initial request or in a reasonable timeframe to allow FBM to respond within the required timeframe.
The disclosures provided by FBM will only cover the 12-month period preceding the receipt of the verifiable consumer request. If applicable, FBM will explain the reasons we cannot comply with a request.
FBM does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If FBM determine that a request warrants a fee, FBM will let you know why we made that decision and will provide you with a cost estimate before completing your request.
F. Modifications and Updates to this California Notice
FBM reserves the right to make changes to any terms of this California Notice at any time, however, FBM shall provide notification to you in advance of any changes becoming effective, such as by posting a notification on or in the Services or via email if you have provided FBM with your email address. If you continue to access and/or use any of the Services after the effective date of such changes, then such access and/or use will be deemed an acceptance of and an agreement to follow and be bound by the terms of the revised California Notice. The revised California Notice supersedes all previous California Notices. For this reason, FBM encourages you to review this California Notice any time you access or use the Services, and FBM recommends that you print out a copy for your records.
